Aegys Kuvasz SAMPLE PURCHASE AGREEMENT AND HEALTH GUARANTEE

This agreement is made and signed this __________day of _______________ by and between Lynn Vogel of Aegys Kuvasz, here in after known as SELLER and ________________________, here in after known as BUYER. SELLER hereby sells a Kuvasz of __________ sex, AKC registration # _________________, microchip # _____________, sired by ______________________ and out of ______________________.

The following terms and conditions are agreed to and understood by the BUYER and SELLER.

1. The BUYER agrees to pay a total purchase price of $________ at or before the time of transfer of dog. If other payment arrangements have been made, then transfer of title will occur when payment in full has been received.

2. The BUYER shall bear all expenses of transferring this dog from SELLER to BUYER.

3. Dog is guaranteed to be in good health and free of any known serious congenital defects as of this date. As of the date BUYER receives dog, dog will have received age appropriate vaccinations and deworming and will have been examined by a licensed Doctor of Veterinary Medicine (DMV). The SELLER does not assume any liability for any injury to said dog after the date of sale.

4. The BUYER agrees to provide necessary medical attention to this animal and to keep it free of all parasites and fleas; said dog shall be given adequate housing, food, exercise and companionship; and shall not be neglected or mistreated in any manner. The BUYER agrees to provide a fenced yard for the dog (the dog shall not be allowed to roam or to be chained). The BUYER is responsible for the dog's temperament and care. The Kuvasz requires a firm home with love and positive reinforcement. Early socialization is a must and children must be supervised at all times. To avoid misinformation, posting to Internet lists regarding this dog are prohibited. Contact the SELLER for guidance.

5. The BUYER agrees that the breeders’ kennel names, Aegys, shall be used as a prefix in the registered name of the dog. Said dog will be named before transfer of title. This is the “__” litter. (ex. Aegys __________, Aegys __________, etc.)

Please write in the name with which you wish to register your Kuvasz. All names subject to approval.

6. The SELLER agrees to replace said dog if any of the following conditions have been documented. Before any replacement is rendered the BUYER must have the dog spayed or neutered and proof provided. The physical conditions that are covered include:

a. Hip dysplasia in an adult dog, i.e. radiographic evidence of degenerative joint disease as determined by the OFA or OVC with the decision being rendered between 18 and 25 months of age depending on organization consulted. A copy of the hip radiographs, including the knees, must be sent to the SELLER. It is the BUYER’s responsibility to maintain the dog in normal weight (no more than 10% above the average for the breed) during all time prior to hip evaluation.

b. Hereditary eye disease, i.e. failure to be certified clear of hereditary eye disease at least twice between the ages of 6 months and 4 years. A member of the American College of Veterinary Ophthalmologists or the Canine Eye Registry Foundation, Inc. (CERF) must provide the eye examinations.

7. Neither this dog, nor any progeny of this dog, shall be used for purposes of vivisection and they shall not be sold by or through any commercial or wholesale establishment, any pet store, or any animal welfare group or ever be placed in an animal shelter or rescue group.

8. If for any reason the BUYER wishes to give up this dog, SELLER shall be given the first right to regain ownership of the dog. The SELLER has the right to interview and refuse any potential buyers of the dog. These conditions being met, if the dog is sold by the BUYER to a third party, BUYER shall furnish such third party a copy of this agreement, shall notify third party of all its terms and provisions and third party shall agree to all terms and conditions of this Sales Agreement, in writing, before sale or transfer is completed. SELLER shall be notified of any such transaction before final transfer of title.

9. If BUYER returns the dog to the SELLER, under the terms of this agreement, the BUYER agrees to complete the AKC transfer of registration for transfer of ownership to SELLER and deliver said registration to the SELLER. All transfer expenses in returning the dog to the SELLER shall be paid by the BUYER.

10. The BUYER shall notify SELLER of any change in address within 30 days of such change.

11. The BUYER is encouraged to report any health, structural, or temperament problems to the SELLER.

12. The SELLER does not guarantee that this dog will achieve any specific titles or other achievements during its lifetime.

13. The BUYER shall notify the SELLER of any titles the dog receives within 30 days of the time that the dog earns said title.

14. The BUYER shall notify the SELLER of dog's death (and the cause of death) within 30 days of the event.

15. The BUYER is required to spay or neuter all dogs sold as pet quality.

16. The BUYER agrees to the following statements regarding all dogs sold as potential breeding quality and all dogs sold with specific spay/neuter agreements.

*The BUYER agrees to breed this dog only if it has been certified clear of hip dysplasia by the OVC or the OFA and has been certified clear of eye defects by CERF.

*The BUYER agrees to breed this dog only to other purebred, registered Kuvaszok that have been certified clear of hip dysplasia by the OVC or the OFA and have been certified clear of eye defects by CERF. The BUYER is also required to evaluate all potential breeding partners for this dog on the basis of overall health, temperament, structure, and working ability.

17. The BUYER will follow Aegys vaccination protocol (sent with dog) and immediately report any possible reactions to SELLER. Failure to follow the Aegys vaccination protocol will render the replacement clause (#6) null and void.

18. The BUYER is encouraged to purchase pet insurance (www.petinsurance.com).

19. The BUYER will contact SELLER before any non-emergency surgical procedures (excluding spay/neuter) or procedures requiring anesthesia/sedation are performed on said dog.

20. BUYER agrees to furnish SELLER with dog’s complete medical records within 30 of request.

21. BUYER agrees to feed Iams Minichunks. Both parties will agree to any change in diet in writing.

23. BUYER agrees to the following additional terms and conditions:

*The BUYER will provide one proven stud service to the SELLER on a male dog.

25. In the event that the BUYER fails to perform any provisions of this agreement, then the SELLER may institute any necessary legal action to regain possession and ownership of this dog with the BUYER forfeiting all further rights to the dog and to the cash consideration paid to the SELLER.

26. Any changes or additions to this contract shall be made in writing and signed by all relevant parties.
